Terms of Service

1. Agreement to Terms
By using the Flameworks Hub software-as-a-service platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you (the "User") and Flameworks Hub ("we," "us").
2. The Service
Flameworks Hub provides a comprehensive platform for appliance service companies to manage work orders, scheduling, customer information, billing, and technician operations. The Service includes a company-facing administrative dashboard, a technician-facing mobile dashboard, and a customer-facing portal.
3. User Accounts
Account Creation
To use the Service, a company representative must create a master account for their service company ("Company Account"). The company can then create or invite its employees (Admins, Technicians) and customers to create user accounts. You are responsible for providing accurate and complete information and for keeping your account credentials confidential.
Account Responsibilities
You are responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account information.
4. Subscriptions and Payment
Free Trial
We offer a 14-day free trial for new Company Accounts. At the end of the trial period, you must subscribe to a paid plan to continue using the Service.
Subscription Plans and Fees
The Service is offered on a subscription basis. Fees are based on the plan you select. All fees are non-refundable, except as required by law. We reserve the right to change our subscription fees upon 30 days' notice to you.
Payment Processing
We use Stripe as our third-party payment processor. By subscribing to our Service, you agree to be bound by Stripe's Terms of Service. All payment information is provided directly to Stripe and is subject to their privacy policy.
5. Third-Party Services
The Service integrates with various third-party services, including but not limited to Google (Gmail and Google Calendar). Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the performance or availability of any third-party services.
By connecting your Google account, you grant Flameworks Hub permission to access your Google data (as described in our Privacy Policy) to provide the integrated features. You can disconnect these services at any time through your account settings.
6. SMS Messaging and Communications
User Consent and Responsibility
By using the SMS features of the Service, you represent and warrant that you have obtained all necessary rights and consents from your customers to send them transactional and promotional text messages. Our Service facilitates a double opt-in process for SMS consent, but you are solely responsible for ensuring your use of the SMS features complies with all applicable laws, including the Telephone Consumer Protection Act (TCPA).
Message Content and Frequency
Messages sent via the Service may include appointment reminders, technician status updates, scheduling information, billing notifications, and marketing offers. Message frequency will vary depending on your business operations and customer interactions.
Opt-Out and Help
All initial messages sent to your customers will include instructions on how to opt-out. End-users can opt-out of receiving SMS messages at any time by replying "STOP". Other keywords such as "UNSUBSCRIBE" or "CANCEL" will also be honored. For assistance, end-users can reply "HELP".
Costs and Carrier Liability
Standard message and data rates may apply to messages sent and received. Flameworks Hub is not responsible for any charges incurred from mobile carriers. Mobile carriers are not liable for delayed or undelivered messages.
7. Acceptable Use
You agree not to use the Service for any unlawful purpose or in any way that could harm, disable, overburden, or impair the Service. Prohibited activities include, but are not limited to:
- Uploading or transmitting viruses or any other type of malicious code.
- Attempting to gain unauthorized access to our systems or other users' accounts.
- Using the Service to send unsolicited communications (spam).
- Violating any applicable laws or regulations.
We reserve the right to suspend or terminate your account for any violation of these terms.
8. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Flameworks Hub and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.
User Content
You retain ownership of all data you upload to the Service, including customer information, work order details, and appliance data ("User Content"). You grant us a worldwide, non-exclusive, royalty-free license to use, host, store, and reproduce your User Content solely for the purpose of providing and improving the Service for you.
9. Termination
You may terminate your Company Account at any time by contacting us. We may terminate or suspend your account at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is otherwise harmful to other users of the Service, us, or third parties.
Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
10. Disclaimers and Limitation of Liability
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the Service's reliability, availability, or accuracy.
In no event shall Flameworks Hub, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.
12. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
